These terms apply to bookings made with Horizontal Traders and work alongside the rental agreement you sign when you collect a vehicle.
Important
These terms operate alongside the rental agreement you sign at vehicle collection. Where the rental agreement deals with something specific to your booking, that agreement applies to it.
About These Terms
Sets out that these terms govern the relationship between Horizontal Traders and a customer making a booking, how they are accepted, and how they interact with the rental agreement and any written quote.
Definitions
Defines the recurring words used throughout, for example hirer, authorised driver, rental period, vehicle, rental agreement, booking confirmation, damage and excess, so that each has one consistent meaning.
Making a Booking
How a booking request is made, when it becomes a confirmed booking, what a confirmation does and does not guarantee, and how vehicle class bookings work where a specific model is not reserved.
The Rental Agreement
Confirms that a separate rental agreement is signed at collection, that it records the conditions applying to that specific vehicle and rental, and that it takes precedence for matters it covers.
Eligibility to Hire
The requirements a person must meet to hire a vehicle and to be recorded as an authorised driver, including licence and identification requirements. Kept deliberately separate from the question of who is legally permitted to drive in Western Australia, which is covered on our Driver Requirements page.
Pricing and Charges
How rates are quoted, what a quoted price includes, which charges are mandatory and therefore included in an advertised price, and how any optional extras are presented and priced.
Payment
Accepted payment methods, when payment is taken, and what happens if a payment is declined or reversed.
Security Deposit or Bond
Whether a security deposit or bond applies, how it is taken and held, what it may be applied against, and when and how it is released. Vehicle Collection
Collection arrangements, identification checks, the condition report, and what the hirer is confirming when they accept the vehicle.
Authorised Drivers
Who may drive the vehicle, how additional drivers are added, and the consequences of an unlisted person driving.
Use of the Vehicle
Permitted use, the hirer’s obligations while the vehicle is in their care, and the uses that are prohibited.
Geographic and Road Restrictions
Where the vehicle may and may not be taken, including any conditions on unsealed roads, remote travel and interstate travel. Area and road restrictions may vary by vehicle and rental arrangement. Please contact Horizontal Traders to confirm the requirements that apply to your booking.
Rental Period
How the rental period is calculated, and when it starts and ends.
Extensions
How a rental may be extended, that extensions depend on availability and confirmation, and how charges apply to an extended period.
Vehicle Return
Return time, place and condition, the return inspection, and how any issue identified at return is dealt with in writing.
Late Returns
What constitutes a late return and what charges apply. Late return charges may vary by vehicle and rental arrangement. Please contact Horizontal Traders to confirm the requirements that apply to your booking.
Fuel and Charging
The fuel or charge level the vehicle must be returned at, and how any shortfall is handled. Fuel and charging arrangements may vary by vehicle and rental arrangement. Please contact Horizontal Traders to confirm the requirements that apply to your booking.
Damage and Liability
How damage is assessed, the hirer’s liability for damage, the applicable excess, and the circumstances in which liability may differ. This clause must be consistent with our Insurance Information page. Excess amounts and liability arrangements may vary by vehicle and rental arrangement. Accidents
What the hirer must do following an accident, the information they must obtain and provide, reporting obligations, and any processing arrangements that apply.
Breakdowns
What to do if the vehicle breaks down, what assistance is available, and what the hirer must not do without our authorisation. Roadside assistance inclusions may vary by vehicle and rental arrangement. Please contact Horizontal Traders to confirm the requirements that apply to your booking.
Loss or Theft
Obligations if the vehicle or its keys are lost or stolen, including reporting requirements.
Traffic Offences and Tolls
Responsibility for infringements and tolls incurred during the rental period, our obligation to identify the driver to the relevant authority, and any administration fee. Cancellations and Changes
How a booking may be changed or cancelled by either party and what applies in each case. Set out in full on our Cancellation Policy page, which this clause must match. Privacy
How personal information collected in connection with a booking is handled, cross-referenced to our Privacy Policy.
Liability
The allocation of liability between the parties, and any limitations or exclusions, all of which must be drafted so as not to purport to exclude, restrict or modify rights that cannot lawfully be excluded.
Australian Consumer Law
Nothing in these terms is intended to exclude, restrict or modify any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other legislation, where doing so would be unlawful.
